1. Acceptance of Terms
By accessing or using the Piece Keeper mobile application and website, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.
2. Eligibility
You must be at least 18 years of age to register for an account and use the Service. By using Piece Keeper, you represent and warrant that you meet this age requirement.
3. User Accounts
To use certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Use of Service
Piece Keeper provides a platform for tracking personal jigsaw puzzle collections and showcasing puzzles for sale via public galleries. You agree to use the Service only for lawful purposes and in accordance with these Terms.
5. User-Generated Content
You retain all rights to the photos and data you upload to Piece Keeper. By uploading content, you grant Piece Keeper a worldwide, non-exclusive, royalty-free license to host, store, and display that content solely for the purpose of providing the Service to you and other users (such as your public gallery).
You are prohibited from uploading content that is illegal, offensive, or infringes on the intellectual property rights of others.
6. Sales and Transactions (The Storefront)
Piece Keeper provides a "Public Gallery" feature that allows users to list puzzles for sale and allows potential buyers to send "Purchase Requests." Piece Keeper is a venue only and is not a party to any transaction between buyers and sellers.
- No Participation: Piece Keeper does not process payments, handle shipping, or facilitate returns. All financial transactions occur off-platform (e.g., via Venmo, PayPal, or cash). By submitting a Purchase Request, a buyer is expressing intent to purchase at the "Snapshot Price" shown at the time of submission.
- Item Accuracy: Sellers are solely responsible for the accuracy of their listings, including brand name, piece count, and condition. Piece Keeper does not verify if a puzzle is complete or as described.
- Order Minimums: Sellers may set a minimum number of puzzles required for a single request. Buyers must meet this minimum to submit or update their request.
- Assumption of Risk: You assume all risk when interacting with other users. Piece Keeper is not liable for "missing piece" disputes, failed payments, fraudulent listings, or shipping damage.
- Taxes: Sellers are responsible for determining and paying any applicable sales or use taxes.
7. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Data scraping, harvesting, or mining of the Piece Keeper puzzle database or user profiles.
- Attempting to interfere with the proper working of the Service or bypassing any measures we may use to prevent or restrict access.
- Uploading fraudulent listings or misrepresenting the condition of items for sale.
- Using the Service for any illegal purpose or to promote illegal activities.
8. Copyright & DMCA
If you believe that any content on Piece Keeper infringes upon your copyright, please submit a DMCA takedown request to piecekeepersupport+report@gmail.com. You may be held liable for damages if you make material misrepresentations in a notification.
9. Premium Subscriptions
Piece Keeper offers a "Premium" tier with additional features. All billing for Premium subscriptions is handled through the Google Play Store. Subscriptions are subject to the terms and conditions of the Google Play Store. Refunds and cancellations must be managed through your Google Play account settings.
10. Limitation of Liability
Piece Keeper is provided on an "as is" and "as available" basis. In no event shall Piece Keeper, its founders, or affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service, even if notified of the possibility of such damage.
11. Dispute Resolution
Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in a class action lawsuit or class-wide arbitration.
12. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation a breach of the Terms.
